"Customer": refers to a natural person of legal age with full legal capacity at the time of signing the reservation contract, or a legal entity duly represented by a natural person with the legal capacity to represent it.
"Hotel": refers to the Best Western Plus Isidore Hotel.
"Website": electronic service operated by the company HÔTEL ISIDORE on the Internet and accessible at the address indicated in the preamble to these terms and conditions.
"Reservation platform": electronic service connected to the Website and allowing online reservations to be made for the Best Western Plus Isidore Hotel.

I. Preamble

1. The company HOTEL ISIDORE, a general partnership, registered under SIREN number 792866469, registered with the Rennes Trade and Companies Register and located at 1 Rue Nicephore Niepce 35136, Saint-Jacques-de-la-Lande, operates the following booking website:

This website presents the Best Western Plus Isidore Hotel and allows users to book rooms and hotel services.
These GENERAL TERMS AND CONDITIONS OF SALE therefore apply to the above-mentioned website.

2. The Customer acknowledges that they have all the information necessary to make their choice and proceed with their reservation on this website:
It is agreed that:
– These General Terms and Conditions of Sale apply to all reservations made on the Hotel's website by individual customers
– These General Terms and Conditions of Sale are not intended to apply to business customers who have signed a specific contract.
3. Any reservation made through the Website implies consultation and full and unreserved acceptance of these General Terms and Conditions of Sale as well as the terms and conditions of sale for the rate reserved, which are expressly mentioned in the description of the rate selected at the time of booking on the Booking Platform.
4. The Customer's acceptance of these general terms and conditions and the terms and conditions of sale for the rate is final once they have checked the box when making their reservation on the website; no reservation is possible without this agreement.
5. The Customer acknowledges that they fully understand these general terms and conditions written in French/English and that they have full legal capacity to commit to these general terms and conditions.
6. The following information is available on the Website and the Booking Platform:
– A precise identification of the Hotel;
– The essential characteristics of the accommodation offered by the Hotel
– The additional and optional services offered,
– Photographs provided for information purposes only,
– Prices including all taxes, excluding tourist tax,
– The amount of tourist tax as applied by the administrative authorities, which is subject to change
– The terms and conditions of sale for the rate booked,
– The terms of payment,
– These General Terms and Conditions of Sale,
– The period of validity of the offer and its price.
7. The Customer declares that this reservation is made for their strictly personal needs. As a consumer, they have specific rights, which would be called into question if the services booked were not for personal use.
8. All information available on the Website and these General Terms and Conditions of Sale are presented in French and English.

II. Subject:

1. These General Terms and Conditions of Sale define the rights and obligations of the parties in connection with reservations made on the Hotel's Website and via the Reservation Platform.
2. The Customer acknowledges having read these General Terms and Conditions of Sale and the terms and conditions of sale for the rate reserved, which are accessible and available at any time on the Website and the Reservation Platform, respectively. The Customer accepts them without reservation.

III. Duration:

1. These General Terms and Conditions of Sale apply for the entire duration of the Hotel's online services.
2. The Company reserves the right, without notice or compensation, to make changes to these General Terms and Conditions of Sale, and to temporarily or permanently close the website or online booking area. To this end, we invite you to consult them regularly.
These General Terms and Conditions of Sale are valid on the date of the Customer's reservation. If a later version appears after the Customer's reservation, these terms and conditions will not apply to their reservation.
3. The Company is not liable for any damage of any kind that may result from these changes and/or temporary unavailability or permanent closure of all or part of the website or associated services, such as the online booking area.

IV. Reservation:

1. The Customer acknowledges that they have made their reservation in full knowledge of the facts and have obtained all the necessary information for this purpose. Room reservations are reserved for individuals who are of legal age and legally competent. By making a room reservation with the Hotel, the Customer expressly declares that they meet these conditions.
2. The Customer may reserve, on the Website, for personal use only, a maximum of 4 rooms for the same date. Any reservation for a greater number of rooms will be subject to the conditions applicable by the Company to Group reservations, thus excluding the application of these General Terms and Conditions of Sale.
Where applicable, the Customer undertakes to contact the Hotel's sales department by email or telephone in order to find out the specific conditions for group reservations and to complete such a reservation.
3. The Customer is solely responsible for their choice of services and their suitability for their needs, such that the Company cannot be held liable in this regard.
4. The reservation is deemed to have been accepted by the Customer at the end of the reservation process.
5. All reservations are nominative and may not be transferred to a third party under any circumstances, whether free of charge or for a fee. Any reservation made for another person must be made in the name of the third party who will be staying at the accommodation.

V. Reservation process:

1. The Customer can reserve a room on the Website's Reservation Platform, accessible from the Website, by clicking on the "Reserve" button.
2. The Customer specifies the dates of their stay and the number of people who wish to stay. They can then choose the type of room and additional services according to their needs and select the rate offered for the selected date(s).
3. The Customer can then confirm their choice by clicking on the "Book" button after reading the full description of the corresponding room(s) and the services included.
4. The Customer is then asked to fill out a form with all their personal information and that of the people staying at the hotel. They must then provide their bank details to guarantee payment on arrival. The Customer certifies that the information provided is true and accurate.
5. The Customer is then asked to confirm their reservation after reading and accepting the General Terms and Conditions of Sale for the selected rate and the privacy policy of the Reservation Platform.
6. The reservation is confirmed. The Customer is taken to a page containing a summary of their reservation. A reservation confirmation is sent by email to the email address provided by the Customer in the form.

VI. Cancellation or modification conditions:

1. If the Customer has booked a non-cancellable and non-refundable rate, they may not cancel their reservation under any circumstances and will not be entitled to any refund, even if they request one.
2. If the Customer has booked a flexible rate, they may cancel or modify their reservation in accordance with the General Terms and Conditions of Sale for the rate selected at the time of booking.
3. Cancellation or modification of a reservation may result in fees as indicated in the General Terms and Conditions of Sale for the rate selected at the time of booking.
4. To cancel or modify their reservation, the Customer must contact the Hotel using the contact details provided on the Website.
5. In the event of an exceptional circumstance or if it is impossible to make the reserved room available to the Customer, for example in the event of force majeure, the Hotel may offer the Customer a room of a higher standard than the one reserved or accommodation in a hotel of at least the same category.

VII. Stay at the Hotel

1. Upon arrival at the Hotel, the Guest may be asked to fill out a police form. To do so, the Guest is required to present a valid ID in order to verify whether or not the Hotel must complete the police form.
Important note: If the Guest fails to present a valid form of identification upon arrival, the Hotel reserves the right to cancel the Guest's reservation without further notice. The Hotel shall not be required to pay the Guest any compensation whatsoever.
2. The Customer agrees and undertakes to make reasonable use of the room and the common areas of the Hotel made available to them. Any behavior contrary to the principles of safety and/or hygiene, morality, and/or public order may lead the Hotelier to ask the Customer to leave the establishment immediately without any compensation and/or refund if payment has already been made.
3. Any damage caused by the Guest in the reserved room or in the common areas of the Hotel may be charged directly to the Guest for the amount of the damage observed. Any item missing from the reserved room and duly noted by the Hotel will be charged directly for its value.
4. All rooms in the Hotel are non-smoking. Penalties equal to a maximum of the price of the first night booked may be applied if the Guest does not comply with the smoking ban in their room.
5. The Guest may occupy their room on the first day of their reservation from 2:00 p.m. They must vacate the room on the last day of their reservation before 12:00 p.m. Failure to do so will result in an additional night being charged. The Customer may enter and leave the hotel 24 hours a day. They will then be asked to leave their room keys at reception.
6. The Customer may request access to their room before 2:00 p.m. on the day of arrival or to keep their room after 12:00 p.m. on the day of departure. This service must be requested on site from the hotel staff, subject to availability and an additional charge.
7. Specific terms and conditions may apply for stays of more than 5 nights.

VIII. Warranties:

The Hotel is bound by the guarantee of conformity of services, under the conditions set out in Articles L. 212-1 et seq. of the Consumer Code.

IX. Liability:

1. In accordance with the laws and regulations governing intellectual property rights, the use and/or reproduction of all or part of the elements comprising the Hotel's offers on the Website is strictly prohibited.
2. The Company shall not be liable for any indirect damages resulting from the present terms and conditions, in particular those caused by a third party, the Customer, or the Hotel's partners.
3. Hypertext links may refer to websites other than the Hotel's website, which disclaims all responsibility for the content of these websites and the services offered. The Company has implemented measures to protect and secure its information system against malicious acts. However, by connecting to the website and making a reservation, the Customer acknowledges and accepts the characteristics and limitations of the Internet. Certain data may not be protected against possible misuse, hacking, or contamination by viruses circulating on the network. The Company declines all responsibility in the event of misuse or incidents related to the use of a computer or any medium allowing access to the Internet, the maintenance or malfunction of the website or any other technical connection, and the sending of information to an incorrect address.
4. Any reservation or payment that is irregular, ineffective, incomplete, or fraudulent for reasons attributable to the Customer will result in the cancellation of the reservation at the Customer's expense, without prejudice to any civil or criminal action against the Customer.
5. In the context of their reservation and stay, the Customer undertakes to behave reasonably and not to cause any harm to members of the Hotel staff or to third parties (or even their animals) present in the Hotel. Such behavior may lead the Hotel to expel the Customer from the Hotel without the Customer being entitled to claim any compensation.

X. Price:

1. The prices for booking services are indicated before and during the booking process.
2. The prices indicated are per room for the number of people and the date(s) selected.
3. Prices are confirmed to the Customer inclusive of all taxes (including VAT) and excluding tourist tax, in the hotel's commercial currency, and are valid only for the period indicated on the website.
4. The total amount of the reservation is payable on arrival at the Hotel.
5. The customer's credit card will be requested at the time of booking to guarantee payment for the reservation.
6. The tourist tax, indicated for each rate, is to be paid directly on site at the hotel. It is subject to change.
7. Prices include VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the prices indicated on the invoice date.
8. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices indicated on the date of invoicing.
9. When the Customer's reservation is confirmed, the total amount of the order will be indicated.
10. Any extras and/or compensation for damage or missing items/furniture will be debited directly from the bank account corresponding to the credit card details provided by the Customer at the time of booking.
In this regard, the Hotel informs the Customer that their bank details are stored from the moment their booking is confirmed. The Hotel reserves the right to use this data for as long as necessary to fulfill the terms of these conditions of sale.
The Customer is informed in advance of the details and amount of any charges that will be made to their account in the event of damage found at the end of their stay.

XI. Payment:

1. Unless special conditions or rates are selected, the Customer shall provide their bank details as a guarantee for the reservation, by credit or private card (Visa, Mastercard, American Express), indicating directly in the space provided for this purpose the card number, its expiry date, and the security code (please note that the card used must be valid at the time of the stay). On the day of arrival at the Hotel, the Customer must present the credit card used to guarantee the reservation or make the prepayment.
The HOTEL may also ask the Customer to present a valid identity document for the purposes of preventing credit card fraud.
Important note: If the Customer fails to present a valid identity document upon arrival, the hotel reserves the right to cancel the reservation outright. The Hotel shall not be required to pay the Guest any compensation whatsoever.
2. Payment is made at the Hotel reception upon the Guest's arrival. The only authorized methods of payment are those mentioned on the Website at the time of booking.
3. At the time of payment, the amount debited at the time of booking includes: the price of accommodation, taxes related to accommodation, the price of meals, taxes related to meals, and any other additional services selected by the Customer, excluding tourist tax and/or any other tax that may be due as a result of the Customer's stay at the hotel.
4. In the event that a company benefits from a post-stay invoice being sent to its customers/employees, it is understood that the invoice is due upon receipt. Payments must be made by bank transfer within three days.
Any delay in payment shall automatically and without prior notice result in late payment penalties, payable on the day following the payment date, equal to one and a half times the legal interest rate. In accordance with Articles L441-6 and D441-5 of the French Commercial Code, any delay in payment shall automatically result, in addition to late payment penalties, in an obligation for the customer to pay a fixed compensation of €40 for recovery costs.
5. Payment of the full price of accommodation and additional services will automatically result in the issuance of a bill (invoice), which will be delivered to the customer in printed form at the hotel or by email. This procedure is displayed at the reception desk.

XII. Personal data:

1. The Customer is informed, on each of the personal data collection forms, of the mandatory or optional nature of the responses by the presence of an asterisk.
2. If information identified as mandatory is not provided, the Hotel may not be able to register a reservation and manage the Customer's complaints.
3. The Customer's personal data collected by the Hotel is processed in accordance with the amended law of January 6, 1978, relating to information technology and civil liberties, for the purposes of executing the Contract, managing reservations, payments, and invoicing, as well as for sending information. This processing is declared to the CNIL (French Data Protection Authority) and the Customer's personal data is kept for the time necessary to perform the service and monitor the commercial relationship and/or for the time necessary to enable the Company to comply with its legal and/or regulatory obligations.
4. The Customer's personal data collected must be communicated to third parties (in particular the manager of the booking platform and the company in charge of the secure payment site) in order for the services to be provided. Some of these third parties may be located abroad. These third parties may only use this data for the same purposes. The third parties have undertaken to take all necessary security measures to ensure the confidentiality of the Customer's personal data.
5. The Hotel reserves the right to use the Customer's personal data for its own marketing operations by sending them, in particular by email, information about its products and services, unless the Customer expressly objects to this when providing their personal data or subsequently by contacting the Hotel, whose contact details are available on the Website.
6. The Customer has the right to access, modify, rectify, oppose, and delete personal data concerning them by contacting the Hotel, whose contact details are available on the Website.
7. The reservation procedure and navigation on the Website may involve the use of cookies. The Customer may disable these cookies at any time if they wish, via their browser settings.
8. The Customer can obtain all information on these subjects by consulting the Legal Notice, Cookies, and Privacy Policy of the establishment.

XIII. Agreement on evidence:

1. Entering the required banking information and accepting these terms and conditions and the voucher or reservation request constitutes acceptance of the hotel contract between the parties and has the same value as a handwritten signature.
2. The computerized records stored in the Company's computer systems will be kept under reasonable security conditions and considered as proof of communications, orders, and payments between the parties.

XIV. Force majeure:

The Company shall not be held liable to the Customer in the event of failure to perform its obligations resulting from a force majeure event on French territory.
Similarly, the Customer shall not be held liable to the Company in the event of failure to perform its obligations resulting from a force majeure event.
Cases of force majeure or fortuitous events are those usually recognized by the case law of French courts and tribunals and French positive law.

XV. Applicable law:

1. These General Terms and Conditions of Sale are governed by French law.
2. This applies to both substantive and procedural rules.

XVI. Completeness:

1. These General Terms and Conditions of Sale, the terms and conditions of sale for the rate reserved by the Customer, and acceptance of the reservation request confirmation express the entirety of the obligations of the parties.
2. No general or specific conditions communicated by the Customer may be incorporated into these general terms and conditions.
3. The documents forming the contractual commitments between the parties are, in descending order of priority, the reservation request (including the specific conditions of the rate reserved) validated by the Customer and these general terms and conditions.

XVII. Changes/modifications to the General Terms and Conditions of Sale

These Terms and Conditions of Sale may be modified and/or supplemented by the Company at any time. In this case, the new version of the Terms and Conditions of Sale will be posted online. As soon as it is posted online, the new version of the Terms and Conditions of Sale will apply to all new reservations made on the Website.

XVIII. Do Not Call List:

To be added to the Bloctel do-not-call list free of charge, you can register on the website https://www.bloctel.gouv.fr/
You will then need to fill out a form, providing up to 10 landline or mobile phone numbers on which you no longer wish to be contacted.

XIX. Consumer mediation:

XX. Right of withdrawal:

The Customer is reminded that, in accordance with Article L. 221-5 of the Consumer Code, they do not have the right of withdrawal provided for in Article L.221-28 of the Consumer Code. The Customer is also reminded that the terms and conditions of sale for the rate reserved and accepted by the Customer specify the terms and conditions for canceling and/or modifying the reservation.
